Mortgage Deed Nightmare: How Contradictions and Delays Nearly Cost Me My Remortgage

   

Introduction:

When you think remortgaging should be straightforward, think again. My recent experience with a solicitor has been a rollercoaster of contradictions, delays, and unnecessary stress—all because of one document: the Mortgage Deed.


What Happened?

I provided every required document months ago:
✔ Official Title Register and Plan from HM Land Registry
✔ Mortgage Offer
✔ Proof of ID
✔ Insurance Details
✔ Service Charge Statements

Yet, despite this, I received six letters claiming that the Mortgage Deed had been sent to me, while the solicitor later admitted that it was never issued because they were “waiting for an updated title register.” The irony? The pending lease extension they referenced has no connection to my remortgage application.


The Contradiction:

  • Portal Status: Displays all documents received, except for the Mortgage Deed.
  • Letters: Claim deed sent and awaiting my return.
  • Email: Confirms that the deed was never issued due to Land Registry delays.
  • Broker: Confirms deed not sent.

This inconsistency has caused contractual risk and financial stress.


What I Did:

  • Contacted HM Land Registry directly and purchased updated title copies.
  • Sent escalation emails to the solicitor, broker, and lender.
  • Prepared a formal complaint and evidence pack for the Legal Ombudsman.

Lessons Learned:

  1. Always verify with the lender whether they require a new title or can proceed with the current one.
  2. Document everything—screenshots, emails, letters.
  3. Set deadlines and escalate early to avoid financial risk.
